Understanding the SARFAESI Act 2002

The Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI) allows banks and financial institutions to enforce security interests without court intervention. Our SARFAESI lawyer in Kolkata explains the key provisions. Section 13 empowers banks to take possession of secured assets if the borrower defaults and the account is classified as NPA. The bank must issue a 60-day demand notice under Section 13(2). If the borrower fails to comply, the bank can take possession under Section 13(4), takeover management, or appoint a receiver. The borrower can file an objection under Section 13(3A). The borrower can appeal against the bank's actions before DRT under Section 17. SARFAESI applies only to secured assets and only for NPA accounts.

SARFAESI Process — From NPA to Auction

The SARFAESI process follows a defined timeline. Our SARFAESI lawyer in Kolkata guides both parties through each stage. When the borrower defaults, the bank classifies the account as NPA (90+ days overdue). The bank issues a notice under Section 13(2) giving the borrower 60 days to repay. If the borrower does not comply, the bank issues a possession notice under Section 13(4), takes physical possession of the property, and publishes the sale notice in newspapers. The bank issues a final sale notice with reserve price. The property is sold through auction. The borrower can stop the process at any stage by paying the dues. We represent borrowers filing objections and appeals, and banks in conducting valid SARFAESI proceedings.

Borrower's Remedies Against SARFAESI

Borrowers have several remedies against illegal SARFAESI actions. Our SARFAESI lawyer in Kolkata helps borrowers by filing objections under Section 13(3A) before the bank within 60 days of demand notice, filing an appeal under Section 17 before DRT after the bank takes possession, filing a writ petition before the Calcutta High Court if DRT is not effective, negotiating a one-time settlement (OTS) with the bank, filing a civil suit in limited circumstances (e.g., fraud or lack of jurisdiction), and seeking stay of possession and sale pending appeal. We also challenge the classification of the account as NPA if the bank has not followed RBI guidelines. The DRT can set aside the bank's action if it is illegal or disproportionate.

SARFAESI Appeals Before DRT

The Debts Recovery Tribunal (DRT) hears appeals against SARFAESI actions under Section 17. Our SARFAESI lawyer in Kolkata handles Section 17 appeals. The borrower must file the appeal within 45 days of the bank's possession notice. The DRT can confirm, modify, or set aside the bank's actions. The DRT can also order restitution and compensation. The appeal must be accompanied by 50% of the amount claimed (waivable in cases of hardship). We draft the appeal, file it with supporting documents, argue before DRT, and pursue the matter up to the Debt Recovery Appellate Tribunal (DRAT) and High Court if needed.

Auction and Sale Under SARFAESI

The auction process under SARFAESI must follow legal requirements. Our SARFAESI lawyer in Kolkata ensures the auction is conducted properly. The bank must publish a sale notice in newspapers with details of the property, reserve price, earnest money, and auction date. The reserve price should be based on a proper valuation. The auction must be transparent and fair. We represent successful bidders in completing the sale and taking possession. We also represent borrowers challenging illegal auctions where the bank sells the property below market value or without proper notice.
